  1. About the Purchase Terms

1.1 These purchase terms and conditions ("Purchase Terms") apply to all purchases you make from villahome.se ("the Website"). You accept the Purchase Terms when you complete a purchase on the Website.

1.2 The agreement is concluded with JCB trading AB with organization number 559170-9612 with address Prästkragevägen 13, 746 37 Bålsta ("the Seller", "us" or "we").

  1. Orders

To make a purchase, you must have the right to enter into an agreement according to applicable law. We do not enter into agreements with persons who are not of legal age (under 18 years). We reserve the right to refuse an order.

  1. Order Confirmation

Once you have completed your purchase, you will receive an automatic order confirmation by email confirming that we have received your order. The order confirmation does not mean that a binding agreement has been concluded. A binding agreement is only concluded when you receive the final delivery confirmation. Before you receive the final delivery confirmation, your order may be refused. We recommend that you save the delivery confirmation to facilitate any future communication with us.

  1. Prices and Information

4.1 Our prices always include VAT. We reserve the right for any printing and writing errors as well as obviously incorrect prices. Suspected cases of fraudulent orders and attempted fraud will be reported to the police.

4.2 If the price of a product or the information about a product stated on the Website is incorrect and you realized or should have realized this at the time of the order, the price or information will not apply to the purchase. In such cases, we will contact you as soon as possible after we have discovered the error.

4.3 All images on the Website showing a product's appearance cannot be guaranteed to reproduce the product's exact appearance, for example due to the monitor's influence on color reproduction. Our products that are or contain parts of natural materials may also have natural variations, and the product's appearance may also vary between different production runs. All images/drawings should be seen as illustrations. Therefore, we cannot guarantee that images/drawings accurately reproduce the products' function, color or appearance. We are not responsible for the accuracy of the images as our suppliers photograph the products and provide the images.

  1. Payment

5.1 Together with our payment service provider Klarna Bank AB, we offer various payment options, and you can choose which payment option you want to use. The possible payment options you can choose from are always shown on the website and in connection with your order. Depending on the option you choose, extra costs may apply. You can find full information about all payment options below. Any costs for your payment option are also always shown before you place your order.

5.2 In connection with placing an order with us, you will enter into a separate payment agreement with our payment service provider. Read terms and conditions at Klarna.

Card payment

You can choose to pay with MasterCard or Visa. Card payments are secure, and we accept all MasterCard and Visa affiliated cards issued in the Nordic countries. Card purchases are made directly with Klarna Bank and are encrypted according to current standards and regulations. No card information is handled or stored by Villahome. The money is debited directly from your account when you approve the transaction and complete your order.

Invoice

We also offer payment by invoice for those who wish to receive the product before paying for it. To purchase by invoice, you must provide your personal identification number or organization number. A prerequisite for purchasing by invoice is, among other things, that you are registered in the Swedish population register and are over 18 years of age. You must not have any payment defaults. All invoices from Villahome.se are transferred to Klarna Bank AB. A standard credit check is performed after the personal data has been submitted at checkout; in some cases, this means a credit report is obtained. A copy of the credit report will then be sent to your home.

Partial payment

We also offer partial payment for your order so that you can flexibly and conveniently choose your monthly cost and do not want to pay all the money at once. You apply for partial payment when you complete your order at the checkout in a simple way. In connection with completing your order, a credit check and an identity check are also performed. Information about this inquiry will be notified to you by mail or SMS. If you are not approved for partial payment, you will receive an immediate answer regarding this, and you can then choose another suitable payment method.

Direct bank payment

With Klarna Direkt, you can easily pay directly at checkout with mobile BankID. Activate the service by logging in at klarna.se and registering your account.

  1. Shipping and Delivery

Delivery options

6.1 We offer several different delivery options. The delivery options we offer are always shown on the Website and at checkout.

6.2 Smaller packages are delivered to the nearest pick-up point and larger packages to the entrance, gate, or driveway. You will be notified by phone. Deliveries normally occur during daytime, 08.00-17.00 on weekdays. In some areas, deliveries only occur 08.00-14.00. With possible exceptions, contact customer service if you are unsure how delivery occurs where you live.

6.3 If your order contains several products, some of which are not in stock with us or have a longer delivery time, we may send the products to you in several deliveries.

Shipping cost

6.4 We offer free standard shipping on orders over SEK 500, unless otherwise stated at the time of purchase. For orders under SEK 500, the current shipping cost is shown at checkout before you complete the purchase.

Delivery time

6.5 The expected delivery time is stated on the website and may vary depending on the item. The estimated delivery time is shown under each product on the website. Please note that the stated delivery may differ depending on where you live in the country and whether the supplier has temporary stock shortages. We always strive to deliver your order within the estimated number of working days for delivery stated on the website.

Stock status

6.6 Villahome.se reserves the right to correct any inaccuracies in stock status and delivery time retroactively. Furthermore, Villahome.se is not obliged to provide a product that has been discontinued or is no longer available even if you have ordered such. In such cases, Villahome.se will always try to find an equivalent product/replacement. If Villahome.se fails to find an equivalent item, the purchase will be canceled, and the entire order amount (including any fees) will be refunded.

Assembly

6.7 Villahome.se does not assist with product assembly. It is your responsibility that products are assembled professionally and according to applicable laws and regulations. Villahome.se disclaims all responsibility for damages arising from incorrectly assembled products and all claims for compensation from customers as a result of such incorrect assemblies.

Unclaimed packages / failed delivery / terminal storage fees

6.8 If you are not available for unloading your order, you will be charged for the costs incurred for so-called failed delivery. This also applies if you miss receiving an installer you booked through Villahome.se. For packages delivered to a pick-up point and not collected, you will be charged a return cost according to the table under the right of withdrawal.

6.9 If you do not follow the instructions for receiving home delivery, for example if you are not home to receive your delivery at the scheduled time, we have the right to charge a fee of SEK 499 corresponding to the extra shipping cost.

  1. Offers, discount codes and gifts

7.1 We may from time to time offer campaigns, discount codes, gifts, and other offers ("Offers"). Such Offers are only valid during the period specified in connection with such an Offer and under the conditions specified in connection with the Offer. Offers cannot be combined with other discounts unless explicitly stated.

7.2 You need to enter any code or otherwise activate the relevant Offer before completing the purchase to take advantage of the Offer. If you return ordered products, it may mean that you no longer meet the conditions for the Offer, which may result in you needing to return any gift or having to pay for the value of the gift. In such cases, we will contact you.

  1. Right of withdrawal and open purchase

8.1 For private individuals, Villahome.se applies the Distance and Home Sales Act and the Consumer Sales Act. According to the Distance and Home Sales Act, you have the legal right to cancel your purchase within 14 days from the day you, or a person on your behalf, receives the product you purchased on the Website.

8.2 However, we do not offer open purchase for items that are not completely unused; read more about this below.

Exceptions for certain products

8.3 Certain products are exempt from the right of withdrawal according to the Act (2005:59) on distance contracts and off-premises contracts, which contains a number of provisions limiting the right to exercise the right of withdrawal.

Special rules regarding manufactured products

a) products that are manufactured to order and therefore not in stock with our suppliers. Villahome hereby informs you, the customer, that according to § 5, the right of withdrawal does not apply if the agreement concerns: "a good that is to be manufactured or substantially altered according to the consumer's specific wishes or that will otherwise have a clear personal character". Examples of this are goods that are manufactured to order and customized according to the customer's wishes, such as customized pools, pool enclosures, stairs, swim spas, pool heat pumps, bicycles, hot tubs, doors, and windows. The right of withdrawal does not apply to agreements under § 11, point 4, which refers to: "for a good that can quickly deteriorate or become too old". For questions regarding service, please contact the manufacturer directly. Villahome.se's customer service will assist you with contact information for the correct manufacturer.

b) products with a broken seal that cannot reasonably be returned due to health or hygiene reasons (e.g., electric shavers and electric toothbrushes) and the seal has been broken by you as the customer, and

c) refers to a product that can quickly deteriorate or become too old, such as flowers and plants.

Depreciation of used products

8.4 When you exercise your right of withdrawal or open purchase, you have the right to open the packaging and examine the product to the extent necessary to assess its nature, characteristics, and function, without the product being put into use.

8.5 You have the right to cancel your purchase for a full refund in these cases if you notify us within 14 days from the day you received the product. If you handle the product to a greater extent than necessary to determine its nature, characteristics, and function, we have the right to make a depreciation deduction. Such a deduction is made by comparing the product's value upon return with its original value at the time of purchase. To receive a full refund when exercising the right of withdrawal, we therefore recommend that you return the product in its original condition.

How to cancel your purchase

8.6 If you wish to return your purchase, you must notify us within the number of days we offer open purchase from the day you receive or pick up your order. You can easily make your return by contacting customer service. You can also use the Swedish Consumer Agency's standard form for exercising the right of withdrawal, which you can find here.

8.7 After you have notified us that you wish to return your purchase, you need to send the product back within 14 days. If it concerns a pick-up of the product from you, we intend for the pick-up to occur within 14 days. We recommend that you send the product back in the same packaging you received it in, as you are responsible for any damage or loss during return shipping due to your negligence, for example, due to insufficient packaging of the product.

Return shipping

8.8 In case of withdrawal and unclaimed/unreceived product, you yourself bear the cost of return shipping when you return your purchase. The cost of return shipping will be deducted from your refund.

8.9 Return cost

The return cost is calculated on a case-by-case basis and depends on the item's weight, volume, dimensions, number of packages, etc.

Refund

8.10 When you have returned your purchase, we will, through our payment service provider, issue your refund within 14 days from the day you notified us that you wish to cancel your purchase. However, we will not issue the refund until we have received the product back or until you have proven that you have sent it to us. We are not responsible for lost returns that have not arrived to us or our supplier.

8.11 Our refund includes any shipping cost you paid in connection with the purchase.

8.12 The refund will be made to you using the same payment method you chose at the time of purchase, unless otherwise agreed.

  1. Complaint

9.1 If there is a defect in your product, you have the right to make a complaint about defects that appear within three years from the delivery of the product (liability period). You always need to make a complaint within a reasonable time from when you should have noticed the defect. Your right to make a complaint expires at the latest two months after the three-year liability period has passed.

9.2 If you wish to make a complaint about a product, you can contact our customer service by emailing us or by using the forms available on the Website. Contact us as soon as possible after you discover the defect. When contacting us, the order number must be provided.

9.3 The difference between warranty and right of complaint is that during the warranty period, the burden of proof lies with the producer to demonstrate that the defect is not an original defect, whereas under the right of complaint, the burden of proof lies with you as the end consumer. In most cases, service workshops are very helpful in determining whether it is an original defect or a user error.

9.4 After a completed purchase, Villahome is responsible for the transport to the customer, for example if the item were to be lost or damaged during transport. If damage has occurred, the customer must report this as soon as possible. When contacting us, the order number must be provided. The customer can find the order number on their order confirmation. In the event of directly visible damage, we ask the customer to report this directly to the carrier upon receipt of delivery. Take a picture of the damage and then contact customer service so we can establish a damage report.

Upon delivery, the customer must always unpack the item and check its condition. In case of transport damage, the packaging must be saved for any complaint to the carrier or exchange of goods. A product where it can be determined that the damage occurred during transport will be replaced with a new, cost-free item.

9.5 Once the complained product has been received and we have determined that the complaint is valid, we will compensate you according to applicable law.

  1. Warranty

When purchasing products, as a private customer, you always have at least a 1-year warranty. Both the warranty and the right of complaint become valid from the moment you receive the product, and the order confirmation serves as a receipt for warranty and complaint cases. Some products have a longer warranty than 1 year, which is stated in the product description on the Website. You always have the right to demand that the manufacturer remedies the defect or redelivers the product in accordance with what applies by law.
